Terms and Conditions Relating to Your Purchase and Use of New Zealand
Travelpass:
New Zealand Travelpass's Fair Trading Contract with you
We wish to set out clearly the responsibilities which we, at New Zealand
Travelpass Ltd, have to you and which you, in turn, have to us when a
contract is made between us. A contract will exist as soon as we confirm
your booking and you make payment either to us or our approved agent.
The contract will include everyone on our confirmation/invoice to you.
We are obliged to provide you with the travel arrangements you have
booked with us on the terms clearly stated below and within this
brochure. Your contract is entered into with New Zealand Travelpass Ltd,
New Zealand.
Fares/Payments and Validity
The fares for our Travelpasses are correct as at 01 June 2003. We
reserve the right to adjust these as necessary. The appropriate fare
will be confirmed to you at the time of booking. If it is different to
what you had expected then you do not have to proceed with the booking.
Once you have paid in full we will hold the price.
Full payment is due when we confirm the travel arrangements.
All prices are in New Zealand dollars and include 12.5% Goods and
Services tax.
Travelpass Validity
All Passes
After you have purchased your Travelpass you must start travel within 6
months.
Travelpass-by-the-Month
These passes are valid for 1, 2 or 3 months from the first day of
travel.
2-in-One, 3-in-One and 4-in-One Passes
These passes are valid for 6 months from the first day of travel.
Website Validity and Accuracy
This website is valid from 01 June 2003 until 30 September 2004 and
supersedes all other issues. The information in this website has been
compiled with diligence and care. Every effort has been made to ensure
its accuracy. However, regrettably errors do sometimes occur. Please
check all details at time of confirmation.
Child Fares
Special fares are available for infants and children up to 11 years of
age inclusive.
Infants (0-1 years): free of
charge (carried on adult's lap - one infant per adult)
Children (2-11 years): 67% of the
adult fare
Adult (12 years and over): adult
fare.
Travelpass Plus!
As well as the general terms and conditions applying to Travelpass,
the following terms are specific to Travelpass Plus!
Travelpass Plus! packages cannot be purchased on arrival in New
Zealand. They must be purchased outside New Zealand prior to
your arrival.
The accommodation vouchers do not guarantee a bed. Reservations
are recommended and can be made upon arrival in New Zealand.
All passengers must be current YHA members. Membership can be
purchased from your local Association before leaving home or you can
obtain a one year international membership when you arrive in New
Zealand for a modest fee of NZ$35.00. Alternatively, you can
purchase a one year membership with your package, simply by adding
NZ$35 to your package price. Your membership will be included in
your Travelpass Plus! documentation.
YHA accommodation vouchers cannot be redeemed on the Milford
Wanderer or the Fiordland Navigator. |
Travelpass Cancellations and Refunds
Purchase Cancellations
If, after we have accepted and confirmed your Travelpass purchase, you
wish to cancel your purchase, a NZ$100 per person administration fee
will apply. A cancellation can only be accepted in writing either from
the person who made the booking or the Travel Agent. The cancellation
will be effective from the date on which it is received by us.
You may be able to claim a refund of your cancellation charges from
your insurance company.
Any unused or partially-used days of your Travelpass are
non-refundable, non-transferable and non-extendable beyond the validity
of the pass.
Travelpass Plus!
The following cancellation and amendment conditions are applicable
to Travelpass Plus! packages:
- Once the package has commenced, no portion of the package is
refundable for whatever reason.
- Cancellations received at least 7 days prior to the proposed
date of arrival in New Zealand will be entitled to a refund less a
cancellation fee of $NZ50 per person.
- Cancellations received in the period which is between 2 and 7
days prior to proposed date of arrival in New Zealand shall be
entitled to a refund less a cancellation fee of $NZ75 per person.
- Cancellations received less than 48 hours prior to proposed
date of arrival or less than 48 hours prior to the start date of
the package shall not be entitled to a refund.
- Cancellations received within 7 days after arrival in New
Zealand (and Clause 4 does not apply) will be entitled to a refund
less a cancellation fee of $NZ75 per person.
- It is recommended that all passengers have comprehensive
travel insurance.

Cancellations or Changes by New Zealand Travelpass Ltd
It is unlikely that we will need to make any changes to your
arrangements, but sometimes it is inevitable. New Zealand Travelpass Ltd
reserves the right to alter fares, amend itineraries or to cancel
arrangements. Assistance will be provided to make alternative
arrangements to a similar value when/where practical.
Refunds are not available when circumstances arise beyond the control
of New Zealand Travelpass Ltd necessitating alternative arrangements to
be made to ensure the safety and/or further participation and enjoyment
of your holiday.
Terms and Conditions of Travel
New Zealand Travelpass holders are subject to the Terms and Conditions
of Travel of the operators of the services travelled on, some of which
limit or exclude liability. Please refer to the General Conditions of
Carriage of Passenger Services of InterCity Coachlines Ltd, Newmans
Coachlines Ltd, TranzRail (2001) Ltd, The InterIsland Line Ltd, Qantas
Airways and Origin Pacific Conditions of Carriage and related
conditions. These Terms and Conditions are available from the carriers.
The carriers reserve the right to amend departure or arrival times and
arrange alternative services without notice. The carriers shall not be
held responsible for any loss or damages resulting from mechanical
breakdowns, strikes, civil disturbances, theft and/or delays or
itinerary changes which may involve additional expense. If for any
reason the carriers cannot honour the Terms and Conditions set out, then
the liability shall be limited to the price of the Travelpass purchased.
The transport carriers listed apply according to the pass type
purchased.
New Zealand Travelpass Ltd shall not be held responsible for any loss
or damage to luggage or personal effects and/or damage resulting in
death or personal injury, which may arise while travelling with New
Zealand Travelpass Ltd or its nominated suppliers.
New Zealand Travelpass accepts no responsibility for timetable
changes that may occur.
Law and Jurisdiction
Any matters arising in relation to the contract between us will be
governed by New Zealand law and subject to the jurisdiction of the
Courts of New Zealand.
Travel Documents
It's your responsibility to ensure that all necessary travel documents
(e.g. passports, visas etc.) are valid and effective. We strongly
recommend that you verify current information with your Travel Agent.
Force Majeure
Compensation will not be payable if we need to cancel or change your
travel arrangements in any way for reasons of war, threat of war, riot,
civil strife, industrial dispute, terrorist activity, natural or nuclear
disaster, fire, adverse weather conditions or other circumstances
amounting to force majeure. |
